Judicial Foreclosures: In Alabama court foreclosures are rare.

Non-Judicial Foreclosures: Out of court proceedings occur much more often than in court. These proceedings will take place once a lender supplies an attorney with the appropriate documents for the foreclosure, the attorney can schedule sale of property. Some mortgages require the lender to send a notice of default 10-30 days before initiating foreclosure process, but it is not required by law.

Sale: Sale requirements within the mortgage must be followed by lender. The notice of sale must be placed in the newspaper for three weeks, or posted at the courthouse and three other public locations. The notice must include a description of property, and the date, location, and terms of sale. It is not required for the notice to be sent to the borrower unless stated in the mortgage.

The borrower has the right to pay off debt at any time, and stop the foreclosure process up till the day of sale unless mortgage says otherwise. The owner is given 12 months to redeem their property.
