Judicial Foreclosures and Non-Judicial Foreclosures: This process begins when the lender sends a notice of default to the borrower. The borrower has 115 days to pay back the full amount due and stop the foreclosure process. In some cases the lender may allow the borrower to stop the foreclosure up to the date of the sale. The notice of default must also be sent to the county recorder; after it is recoded the lender can schedule the foreclosure sale.
Sale: No less then 120 days before the sale date a notice of the sale must be mailed to the borrower. This should include the borrowers name, description of the property, the default information the amount owed, and the sale date, time, and location. The lender must also publish the notice in the local newspaper once a week for four weeks, with the final publication to be at least 30 days before the sale date.
The attorney of the trustee will conduct the sale. The winning bidder is entitled to the property 10 days following the sale.
