Judicial Foreclosure: In the state if Iowa court foreclosure can occur with or without redemption rights. The lender typically delivers a written notice of default to the borrower 30 days prior to beginning the process, the notice will include the exact amount owed, and when it must be paid. If the amount is not paid then the lender may go on with the foreclosure process. If the lender chooses to pursue the foreclosure without redemption, the borrower can demand the sale to be delayed for 6-12 months.
Non-Judicial Foreclosure: Borrowers can voluntarily agree to an out-of-court foreclosure.
Sale: The sheriff handles the sale, it is their responsibility to distribute and publish the notice. The notice should be posted in at least three public places, with one of them being the public courthouse. In addition there must be two newspaper publications per week, and the first should be in four weeks before the sale date. If the lender chooses to foreclose with out redemption then the winning bidder automatically receives the deed. Otherwise redemption periods can last anywhere from 30 days to 6 months.
