Judicial Foreclosure: To begin this process the lender must file a complaint against the borrower, and obtain a decree of sale. The court will rule whether the default has occurred, if the court finds a default they will decide on the amount of debt, and other cost, which are due, and set a reasonable date for this money to be paid. The court may decide that if the debt is not paid in time that the property will be sold to settle the debt. Before the sale takes place the lender does not have to send word to the borrower.
Non-Judicial Foreclosure: In the state of Maryland out of court foreclosure procedures are not used.
Sale: To begin the foreclosure sale process a notice of sale must be published in the local newspaper for three weeks in a row. The trustee will also send a notice of sale to the borrower at least 10 days before the date of sale. The sale takes place at the court house, after the winning bidder has been recognized, a notice that the sale has occurred is published in the newspaper. The owner has 30 days to make an objection, if there is no objection the sale will be confirmed, and the ownership is transferred to the bidder.
