Judicial Foreclosures: In the state of Tennessee in-court foreclosures are rarely used because most mortgages include a power-of -sale clause, which allows the lender to sell the property if the borrower has defaulted.
Non-Judicial Foreclosures: This process begins once a borrower had defaulted. The lender will advertise and publish a notice of sale. The borrower can stop the foreclosure anytime prior to the sale by paying the full amount owed. The typical foreclosure takes about two months.
Sale: A notice of sale should be published in the local newspaper at least three times before the sale date. The notice should include the name of all affect parties, a description of the property, as well as the date, time and location of the sale. A trustee conducts the sale and the ownership is transferred to the highest bidder.
