Judicial Foreclosure: To begin this process the lender will file suit against the borrower for the amount owed. If the court finds the borrower in default the court will settle on an appropriate amount and will give the borrower a sufficient amount of time to pay back the debt. If the borrower is unable to pay the allotted amount, a sale date is scheduled.
Non-Judicial Foreclosure: In the state of Utah out-of-court proceedings are not used.
Sale: A notice of sale is published three months following the notice of default being recorded. The notice should be published in a local newspaper once a week for three weeks. The final publication must be between 10-30 days prior to the sale. The sale is conducted through a public auction, and the property is awarded to the highest bidder. There is usually no redemption period following the sale in an out-of-court proceeding.
