Judicial Foreclosures: In-court proceedings sometimes occur in Washington D.C., but most are done out of court.
Non-Judicial Foreclosures: To hold an out-of-court preceding the mortgage or deed of trust must include a clause, which allows the lender to sell the property. The lender must notify the borrower that the mortgage or deed of trust has been violated. The borrower can stop the foreclosure up to five days before the sale by paying the default amount. Following the sale the borrower has no right to redeem the property.
Sale: The lender must notify the borrower of the sale of property by certified mail at least 30 days before the date of sale. The mayor and the recorder of deeds must also be notified and receive copies of the notice. The lender must follow the advertising requirements noted in the deed of trust. Typically the lender will advertise in the Washington Post or the Washington Times five times prior to the sale.
