Judicial Foreclosures: In the state of West Virginia in-court foreclosures are used but are not common.
Non-Judicial Foreclosures: To begin this process the lender must first notify the borrower of default, and impending foreclosure. It will also inform the borrower of the option to pay off the default amount and stop the foreclosure. According to state law the lender is not able to make the full loan amount due immediately, but once the borrower has been notified the lender can accelerate the loan.
Sale: A notice of sale should be published in the local paper once a week for two to four weeks. A copy of the notice should also be mailed to the borrower. The sale is conducted through a public auction, and the property is sold to the highest bidder. The deed will be transferred to the purchaser with in 30 days. There is no redemption period for the borrower.
