Judicial Foreclosure and Non-Judicial Foreclosure:: The lender begins the foreclosure process by filing the appropriate documents with the court. The lender must also notify the borrower of their actions. Once the court has made their decision on the foreclosure the borrower has anywhere from 6-12 months to pay off the amount owed and stop the foreclosure.
Sale: After the borrowers redemption period has ended the sheriff gives notice of the time and place of the sale. A notice of sale should be published in the local newspaper within the 12-month redemption period, but the first publication has to be 10 months after the courts ruling. The sheriff conducts the sale; any party with 10 percent of their maximum bid at the sale may bid. The winning bidder will receive ownership of the property once the court confirms the sale. The property cannot be confirmed if it has sold for less the amount owed.
