Judicial Foreclosure: In the state of Wyoming in-court proceedings occur less often because most mortgages included a power-of-sale- clause.
Non-Judicial Foreclosure: When there is a power-of-sale clause in the mortgage the lender has the right to sell the property once the borrower has defaulted. A notice must be sent to the borrower at least 10 prior to the publication of the notice of sale.
Sale: A notice of sale should be published in the local newspaper once a week for four weeks in a row. The sale is conducted through a public auction with the property being awarded to the highest bidder. The highest bidder will receive a certificate of purchase. The borrower has three months after the sale to redeem the property; they must pay the amount of the purchase price at the auction. If the borrower does not fulfill this request, the property is handed over to the winning bidder.
